Terms of Service

1. Agreement

By using Morel Flourish (“Flourish,” “the app,” “our service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the app. These Terms are a legal agreement between you and Morel (“we,” “us,” “our”), based in Minneapolis, Minnesota.

2. Eligibility

You must be at least 16 years old to use Morel Flourish. By creating an account, you represent that you meet this requirement.

3. What Morel Flourish Does

Morel Flourish is a wellness application that helps you track fitness activity, nutrition, and health metrics. Features include integration with fitness platforms (such as Garmin), meal photo logging and identification, macronutrient tracking, workout planning, and personalized wellness insights.

4. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to notify us promptly if you believe your account has been compromised.

5. Health and Wellness Disclaimer

Morel Flourish provides general wellness information only. The app is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Workout plans, meal suggestions, nutritional information, and any other guidance provided through the app are for informational and general wellness purposes only. They do not constitute medical advice, dietary counseling, physical therapy, or any form of professional healthcare.

You should always consult a qualified healthcare provider before beginning any new exercise program, changing your diet, or making decisions about your health — particularly if you have any pre-existing medical conditions, injuries, or are recovering from surgery.

By using Morel Flourish, you acknowledge that you are voluntarily participating in physical activity and nutritional programs, and you assume full responsibility for any risks associated with doing so.

6. AI-Powered Features

Morel Flourish uses artificial intelligence services (currently Google's Gemini API) to provide features such as meal identification, nutritional analysis, and personalized recommendations. AI-generated content may be inaccurate, incomplete, or unsuitable for your individual circumstances. You should treat AI-generated suggestions as a starting point, not as authoritative guidance. We are not responsible for errors, omissions, or inaccuracies in AI-generated content.

7. Anonymous Meal Database

Morel Flourish maintains a shared, anonymous database of meal and restaurant nutrition information contributed by users. By using the app with the default settings, you agree to contribute anonymized meal data (photos, macronutrients, and restaurant identifiers) to this database. You can opt out at any time in your settings.

Data contributed to the anonymous meal database is stripped of personally identifiable information and cannot be traced back to you. Once contributed, anonymized data becomes part of the shared database and is not removed if you later opt out or delete your account, since it is no longer associated with you.

We do not sell data from the anonymous meal database to advertisers or other third parties. The database exists to improve the experience for all Morel Flourish users.

8. Your Content

You retain ownership of all content you create or upload through Morel Flourish, including meal photos, workout logs, and other personal data. By using the app, you grant us a limited license to store, process, and display your content back to you as part of the service, and to anonymize and include meal data in the shared database as described in Section 7 (unless you opt out).

9. Acceptable Use

You agree not to:

  • Use the app for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or other users' data
  • Interfere with or disrupt the app or its infrastructure
  • Upload content that is illegal, harmful, or infringes on the rights of others
  • Reverse engineer, decompile, or otherwise attempt to extract the source code of the app
  • Use the app to build a competing product or service

10. Third-Party Integrations

Morel Flourish integrates with third-party services such as Garmin and AI providers. Your use of these integrations is also subject to the respective third party's terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

11. Limitation of Liability

To the fullest extent permitted by law, Morel and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, loss of data, or loss of profits, arising from or related to your use of Morel Flourish.

Our total liability to you for any claim arising from or related to the service shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.

This limitation applies regardless of the legal theory on which the claim is based, including negligence, breach of contract, or strict liability.

12. Disclaimer of Warranties

Morel Flourish is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components, or that any content — including AI-generated content — will be accurate or reliable.

13. Indemnification

You agree to indemnify and hold harmless Morel and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the app, your violation of these Terms, or your violation of any rights of another party.

14. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of Morel Flourish at any time, with or without notice. We will make reasonable efforts to notify you of significant changes.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or via email. Your continued use of Morel Flourish after updated Terms take effect constitutes your acceptance of the changes.

16. Termination

You may stop using Morel Flourish and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the service. Upon termination, your right to use the app ceases, but provisions that by their nature should survive (including Sections 5, 8, 11, 12, and 13) will remain in effect.

17. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the service shall be resolved in the courts located in Hennepin County, Minnesota.
